FERC Arbitrarily Rejected Amazon Nuclear Energy Deal, Court Told

The Federal Energy Regulatory Commission arbitrarily and unlawfully rejected a contract outlining the sale of electricity from Susquehanna Nuclear LLC’s Pennsylvania plant to support a nearby Amazon data center, the nuclear plant owner told the Fifth Circuit.

Susquehanna Nuclear argued that FERC improperly implemented its own test for nonconforming provisions in its brief filed Monday in the US Court of Appeals for the Fifth Circuit.

That test looks at whether the terms of a proposed amended interconnection service agreement have specific reliability concerns, novel legal issues, or other unique factors, the company said.
