Exxon, Suncor Energy Lose Appeal in Colorado Climate Case (2)

A federal appellate court on Tuesday tossed an appeal from oil and gas companies looking to keep a Boulder, Colo., climate liability case in federal court.

The decision is the first to come down from judges considering a fuller suite of energy company arguments, as mandated by a Supreme Court order in a similar Baltimore case last year.

The companies—including Suncor Energy Inc. and Exxon Mobil Corp.—failed to prove any six of their claims to move the case from state to federal court, a panel from the U.S. Circuit Court of Appeals for the Tenth Circuit ruled.
