A trio of judges at the US Court of Appeals for the District of Columbia Circuit seem poised to uphold an EPA assessment of cancer risks from ethylene oxide after arguments on Friday.
The Environmental Protection Agency met chemical industry challengers in Huntsman Petrochemical LLC v. EPA, a case centering on a rule that used cancer risk calculations from a 2016 Integrated Risk Information System to justify 2020 hazardous air pollutant standard revisions for organic chemical manufacturing facilities’ ethylene oxide emissions.
