EPA’s Renewable Fuel Standards Provoke Slew of Litigation

Environmental and fossil fuel organizations are among the groups that have launched a cluster of lawsuits challenging the Environmental Protection Agency’s latest standards for renewable fuel.

The final agency action establishes the applicable volumes and percentage standards for 2023 through 2025 for cellulosic biofuel, biomass-based diesel, advanced biofuel, and total renewable fuel. The rule was published July 12 and went into effect Sept. 11, which was also the deadline for court challenges to be filed.
