EPA’s 2024 Fuel Economy Testing Standards Vacated on Appeal (1)

Agricultural groups on Tuesday won their challenge to a portion of the Environmental Protection Agency’s final fuel economy testing regulations.

The EPA’s rule is “unreasonable and unreasonably explained,” violating the Administrative Procedure Act, the US Court of Appeals for the Fifth Circuit said.

Texas Corn Producers, National Sorghum Producers, and other industry groups sued the EPA over its 2024 rule that established more protective emissions standards for criteria pollutants and greenhouse gases for certain light-duty and medium-duty vehicles.
