EPA’s Bid for Quick Appeal of Flint Water Suit Denied by Judge

The EPA’s attempt to get the Sixth Circuit to review a Michigan federal judge’s decision that it must face claims that it failed to timely warn residents of Flint, Mich., about the health risks in the city’s water supply.

Judge Linda V. Parker of the U.S. District Court for the Eastern District of Michigan denied the government’s request to certify an interlocutory appeal to the U.S. Court of Appeals for the Sixth Circuit because her April decision to deny immunity was based on “too fact-intensive an inquiry,” she said.
