EPA Violated Water Law’s Science Mandate for PFAS, Court Told

An appeals court should vacate the EPA’s drinking water limits for PFAS as the agency failed to use the best available science as required by law, two scientific nonprofits said in a brief backing challengers to the rule.

The Toxicology Excellence for Risk Assessment (TERA) and the International Society for Regulatory Toxicology and Pharmacology on Tuesday submitted a friend of the court brief supporting water utilities and industry groups opposed to the Environmental Protection Agency’s 2024 regulation in the US Court of Appeals for the District of Columbia Circuit.
