The US Supreme Court should block an attempt to quash a ruling that allowed the EPA to further explain the implementation of its traveling ozone rules, according to a brief filed Tuesday.
Republican-led states, who won court bids to temporarily freeze parts of the “Good Neighbor” ozone standards, are now challenging a lower court decision that asked the Environmental Protection Agency to explain how the cross-boundary pollution rule would work with multiple states out of the picture for compliance.
Petitioners told justices that the agency cannot retroactively add new information outside of the notice-and-comment period.
