The EPA this year reached for authority it does not have when it scrapped a Biden-era proposal to shore up more stringent air pollution mandates for industrial facilities under the new source permitting process, according to an opening brief filed by green groups.
The Biden administration last year floated changes to the Clean Air Act’s New Source Review protocol, which grants permits to proposed facilities based on their size, emissions, and other factors. The proposed changes would have lowered the bar on what is considered a big project with added emissions that requires full review as a new source.
