EPA Termination of Billions in Green Grants Struck Down in Court

A federal judge ruled Thursday that the Environmental Protection Agency unlawfully terminated a Congressionally-appropriated $2.8 billion green grant program last year.

The US District Court for the District of South Carolina vacated the agency’s decision to scrap the Environmental and Climate Justice Block Grant Program, which funded water quality improvements and climate projects for 17 cities and more than a dozen nonprofits.

The EPA’s guidance to shutter the program contravened Congress’s instructions in the Inflation Reduction Act to keep the green grants available through September 2026, thus violating the Administrative Procedure Act, Judge Richard M. Gergel ruled.
