More stringent rules governing traveling ozone pollution were crafted well within the bounds of the EPA’s Clean Air Act mandates, according to an agency brief filed late Monday.
The Environmental Protection Agency told judges in the US Court of Appeals for the District of Columbia Circuit that its “Good Neighbor” rule, aimed at limiting wandering ozone pollution, relies on a time-tested and “sensible approach” to regulating industry in upwind states.
The rule also adequately accounts for states that are temporarily exempt from implementing the two-part rule due to stay orders from regional courts currently hearing multiple cases contesting the standards. ...
