Environmentalists have no basis to sue the Environmental Protection Agency over a Department of Energy report that supports the agency’s proposal to scrap legal language about greenhouse gas dangers, according to the EPA’s motion to dismiss.
The Environmental Defense Fund and the Union of Concerned Scientists filed suit in August in the US District Court for the District of Massachusetts, arguing the EPA relied on a DOE report crafted by a “secret” Climate Working Group (CWG) to support a proposed rulemaking that would revoke the agency’s 2009 endangerment finding.
