EPA Must Review San Francisco Water Rule Decision, Judge Says

The U.S. Environmental Protection Agency must reconsider whether parts of San Francisco Bay tidal wetlands and marshes are protected under the Clean Water Act, under a judge’s order Monday.

Judge William Alsup of the U.S. District Court for the Northern District of California vacated a previous EPA ruling and ordered the agency to review its decision that development of the Redwood City Salt Ponds was not restricted under the waters of the U.S. rule.
