EPA Justice Grant Cancellation Meets Skeptical Appeals Court

The Environmental Protection Agency’s cancellation of a $2.8 billion climate justice program is unlikely to survive a federal appeals court challenge after a three-judge panel appeared skeptical Monday of the agency’s claim that the funds are no longer obligated to municipalities and environmental groups.

During oral arguments, the US Court of Appeals for the DC Circuit panel cast doubt on the government’s claim that Congress rescinded the grant award in the massive GOP spending bill passed last summer, grilling the EPA’s counsel on the exact status of the funds.
