EPA Faces Challenge to Blocking Water Filtration Product Sales

A water filtration company is asking the First Circuit to block the Environmental Protection Agency’s order to stop selling its products after the agency classified them as mislabeled pesticides.

“The EPA’s action here marked a significant departure from its historical treatment,” of the company’s products, Berkey International LLC said in its brief filed with the US Court of Appeals for the First Circuit on Monday.

The agency will consider the water filter elements as mislabeled pesticides under the Federal Insecticide, Fungicide, and Rodenticide Act until they are properly labeled and registered, the brief said.
