The Environmental Protection Agency beat a suit challenging its interim health advisory levels for PFOA and PFAS chemicals after the D.C. Circuit dismissed the case for lack of standing.
The American Chemistry Council sued the agency in July, claiming that advisory levels of 0.004 parts per trillion for perfluorooctanoic acid (PFOA) and 0.02 ppt for perfluorooctanesulfonic acid (PFAS) are impossible to implement and enforce, as they are well below technical detection limits established by the agency.
The EPA used flawed science to develop the advisories, which violates the Safe Drinking Water and Administrative Procedure acts, the group alleged.
