EPA Asks Judge to Toss Trump-Era Reversal of Pebble Mine Limits

The EPA formally asked a federal judge in Alaska to vacate a Trump-era decision that withdrew proposed pollution limits for the Pebble Mine project in the state’s Bristol Bay region.

The Environmental Protection Agency can withdraw a proposed determination in situations where “the discharge of materials would be unlikely to have an unacceptable adverse effect.” Here, the agency “failed entirely to address the standard,” according to its filing in the U.S. District Court for the District of Alaska.
