EPA Argues Against Country-Wide Ban on Civil Rights Regulations

The Environmental Protection Agency asked a federal court to once again reject Louisiana’s request to ban nationwide the agency’s civil rights regulations for investigating federal infrastructure funding because the state isn’t injured when others states receive funding under those rules.

Louisiana successfully stopped the agency from citing non-direct impacts of trends like cumulative pollution for civil rights cases challenging environmental permits in the state. However, Louisiana hasn’t proven injury outside its borders to justify a broader ban, the EPA told the US District Court for the Western District of Louisiana on Thursday.
