The US Environmental Protection Agency on Tuesday appealed a lower court’s ruling that blocked an expansion of which waters are under federal jurisdiction.
The lawsuit, brought by 24 states and a slate of agricultural and industry groups, says the agency is exceeding its authority and that President Joe Biden’s Water of the United States rule is overly vague and premature. The 2023 rule mostly reverts Clean Water Act wetlands jurisdiction to its status under the Obama administration.
