Environmentalists Lose Push to Tighten EPA Corrosivity Standards

The EPA doesn’t need to tighten its corrosivity standards under the Resource Conservation and Recovery Act, the D.C. Circuit ruled Tuesday in a loss for an environmental group.

“PEER has missed—by more than four decades—the 90-day deadline to file a direct challenge to the regulation,” Florence Y. Pan wrote for a three-judge panel on the US Court of Appeals for the DC Circuit.

Public Employees for Environmental Responsibility petitioned the Environmental Protection Agency to tighten its corrosivity standards over concerns stemming from 9/11, saying that cement dust contributed to long-standing health problems for many first responders.
