Environmental advocacy groups have chosen to drop their request for a federal appeals court to review a coal ash disposal rule that the EPA issued in November.
The Alliance for Affordable Energy, PennEnvironment Inc., and the Sierra Club asked the U.S. Court of Appeals for the District of Columbia Circuit to review the agency’s Nov. 12 rule, which creates a procedure for utilities to request approval to use certain natural coal ash landfill and pond liners, as opposed to synthetic materials.
