Environmental groups appealed to the Fifth Circuit on Monday a lower court decision that vacated the protection of the lesser prairie-chicken under the Endangered Species Act.
“Conservation Groups seek to appeal the denial of their motions to intervene and this Court’s order on vacatur,” the Center for Biological Diversity and Texas Campaign for the Environment said in their notice of appeal filed to the US District Court for the Western District of Texas.
