Energy Department Says Grant Limits Not Subject to Court Review

The US government is calling for the dismissal of states’ claims against the Energy Department’s decision to restrain grants, saying the relevant federal court lacks jurisdiction.

The challenged agency action isn’t actually appropriate for judicial review, DOE told the US District Court for the District of Oregon Monday.
