Energy Companies Denied Federal Venue in Oakland Climate Appeal (1)

Five energy companies will have to fight another climate deception battle in California state court after circuit judges rejected an appeal to keep the case under federal jurisdiction.

BP PLC, Chevron Corp., ConocoPhillips, Exxon Mobil Corp., and Royal Dutch Shell PLC couldn’t convince judges at the U.S. Court of Appeals for the Ninth Circuit that San Francisco and Oakland’s climate case raises federal issues. The unpublished decision affirms a district court ruling that the county and cities’ claims could be heard by state judges.
