Effective Use of Lone Pine in Fracking, Other Toxic Injury Cases

In May 2012, the natural gas industry scored an important victory when a Colorado trial court dismissed Strudley v. Antero Resources Corp., a case brought by a family claiming that hydraulic fracturing for shale gas (fracking) caused them personal injury and property damage.

The dismissal of Strudley followed the plaintiffs’ failure to satisfy the trial court’s Lone Pine order requiring them to produce before discovery reports from qualified experts opining that there existed a causal link between their alleged injuries and the defendants’ nearby fracking operations. 1Strudley v.
