DuPont, Chemours Lose Appeal to Avoid NJ Township’s Waste Case

A state appeals court affirmed a New Jersey township has standing under state environmental law to sue E.I. DuPont de Nemours and Co. and others over the disposal of more than 100 million pounds of hazardous waste.

The New Jersey Superior Court, Appellate Division, ruled Tuesday that Carneys Point Township, a community nestled less than an hour southwest of Philadelphia, had standing to sue DuPont and the Chemours Co., given the New Jersey Department of Environmental Protection didn’t initially take action.
