Denka Performance Elastomer LLC was successful in securing more time to comply with Environmental Protection Agency air pollution standards for chloroprene and ethylene oxide after the Fifth Circuit granted its request for a stay.
The Louisiana Department of Environment Quality’s approval of a two-year extension for Denka to comply with the EPA’s air toxics rule will remain in place while the US Court of Appeals for the Fifth Circuit resolves the validity of the extension. The appellate court granted the stay Wednesday in a short two-page unpublished order.
