Denka Expands Legal War Against EPA Chemical Emission Rules (1)

Denka Performance Elastomer LLC launched another legal brawl against the Environmental Protection Agency, which is under growing courtroom pressure for its crack down on carcinogenic emissions from a Louisiana neoprene facility.

Denka filed a petition against the agency at the US Court of Appeals for the Fifth Circuit on Thursday, claiming that the EPA’s override of an extension issued to the company for new air toxics rules amounts to “a politically motivated, unscientific crusade” to effectively shut down the facility.
