Delta Customers Can’t Sue Over Carbon-Neutral Ads, Airline Says

Delta Air Lines says a case alleging that it falsely advertised being a carbon-neutral company should be dismissed because those claims are blocked by federal law.

The airline told the US District Court for the Central District of California on Friday that the state laws Delta customer Mayanna Berrin sued under are preempted by the Airline Deregulation Act, which prevents states from enforcing laws that relate to an airline’s rates, routes, or services, Delta said.
