Delta Air, Others Must Face Washington Residents’ Pollution Suit

Delta Air Lines Inc., Alaska Air Group Inc., and the Port of Seattle lost their bid to get claims tossed from Washington state residents who alleged contamination from the nearby airport have led to health issues.

The airlines and port failed to properly support their arguments over preemption, standing, and jurisdiction, Judge Jamal N. Whitehead of the US District Court for the Western District of Washington said on Monday.

The residents had originally claimed in state court that Seattle-Tacoma International Airport flights contaminated nearby neighborhoods with dangerous pollutants such as carbon monoxide, lead, and particulate matter. More than ...
