Dakota Access Pipeline Running Unlawfully, Tribe Says on Appeal

The US Army Corps of Engineers hasn’t followed federal law by allowing the Dakota Access Pipeline to operate without proper documentation, the Standing Rock Sioux Tribe claimed.

“The Corps has unlawfully withheld mandatory actions required under the Mineral Leasing Act and the Clean Water Act, allowing DAPL to continue operating on federal land without a valid easement or a legally compliant Facility Response Plan,” the tribe said in its brief filed Wednesday with the US Court of Appeals for the DC Circuit.
