CSX Deal to Convert Indiana Tracks to Trail Draws Landowner Suit

Indiana landowners say that the federal government unlawfully took their land for a public recreation trail without providing compensation, according to a proposed class action filed in federal court.

The Surface Transportation Board granted in 2010 CSX Transportation’s petition to discontinue service of a 62-mile segment of rail between Bedford and New Albany, in southern Indiana. In 2017, Indiana Trails Fund Inc. asked the agency to use the corridor for a trail, and CSX notified the agency that it agreed to negotiate with Indiana Trails and New Albany for interim trail use and railbanking.
