Court Revives Lead-Related Suit Against Michigan City Officials

Benton Harbor, Mich., officials must face civil rights charges against them related to drinking water contaminated with lead, a federal appeals court ruled Tuesday.

The US Court of Appeals for the Sixth Circuit reversed the US District Court for the Western District of Michigan’s 2023 dismissal of the claims against the city and remanded the case. But the panel affirmed the lower court’s dismissal of claims against Michigan state officials.

The plaintiffs’ “allegations regarding city officials tell a plausible tale of deliberate indifference to a known risk of harm,” the court ruled.
