Court Refuses to Freeze EPA Rules Governing Chemical Emissions

Denka Performance Elastomer LLC lost its bid for an emergency pause of the EPA’s stringent new limits on chloroprene, according to a brief order handed down on Wednesday.

A panel at the US Court of Appeals for the District of Columbia Circuit wasn’t convinced that the Louisiana manufacturer would be irreparably harmed should the 90-day compliance period be implemented as scheduled.

“Petitioner has not satisfied the stringent requirements for a stay pending court review,” according to the per curiam decision. Judges Gregory G. Katsas, Neomi Rao, and J. Michelle Childs were on the panel.
