Court Extends Trump Water Rule to One State Without It: Colorado

A federal appeals court on Tuesday tossed a lower court decision that had blocked a Trump-era federal waters jurisdiction rule from taking effect in Colorado.

The U.S. Court of Appeals for the Tenth Circuit ruling means the Trump-era rule is now in effect nationwide.

“The 2020 Navigable Waters definition is now in effect in Colorado, as it has been in the rest of the nation since last year,” said Tony Francois, senior attorney for the Pacific Legal Foundation.
