Corona Clay Seeks High Court Review of Water Pollution Dispute

Corona Clay Co. wants the U.S. Supreme Court to consider whether conservation groups can sue even though a jury held they failed to prove the company released pollution into protected waters, according to a petition submitted to the high court.

The U.S. Court of Appeals for the Ninth Circuit said the groups can sue based on “ongoing or imminent procedural violations.” This decision opens up the possibility of lawsuits based on “nothing more than reporting violations,” as long as some pollution happened at some undefined time, the company told the high court.
