Colorado is seeking a federal court’s permission to block the Trump administration’s water rule from taking effect in the state because it lacks a similar program to protect many of the states’ wetlands and streams.
In a motion filed Thursday, the state asked the U.S. District Court for the District of Colorado to block the Navigable Waters Protection Rule (RIN: 2040-AF75). The joint rule from the Environmental Protection Agency and Army Corps of Engineers takes effect June 22 and narrows what types of wetlands and water bodies qualify for Clean Water Act protections.
