The Bureau of Land Management failed to timely act on an application to lease federal coal interests, a North Dakota mining company said in a lawsuit seeking to spur agency action.
The agency hasn’t completed an environmental assessment of the application under the National Environmental Policy Act despite it being submitted four years ago, Falkirk Mining Co. told the US District Court for the District of North Dakota on Thursday.
