Citigroup Loses Bid to Dismiss CERCLA Lawsuit Over Slag Waste

Citigroup Inc. must face a lawsuit alleging that its subsidiary, MRC Holdings Inc., mishandled slag waste at a site in Illinois after a judge declined to dismiss most of CTI Development Inc.'s federal and state law claims.

CTI alleged the facts necessary to support a claim of landowner liability under the Comprehensive Environmental Response, Compensation, and Liability Act, and it provided adequate notice to Citi and MRC of its intention to file a citizen suit, Judge Stephen P. McGlynn of the U.S. District Court for the Southern District of Illinois ruled.
