Chemours Wins Appeal to Undo Forced Water Permit Compliance

The Chemours Co. successfully convinced the Fourth Circuit on Wednesday to reverse a judge’s order blocking the company from releasing hexafluoropropylene oxide dimer acid (HFPO-DA) above limits set in its water permit.

The federal court judge in West Virginia was wrong in finding that a preliminary injunction was needed to prevent irreparable harm, the US Court of Appeals for the Fourth Circuit ruled.

The lower court’s “irreparable harm analysis rested on legal and factual errors,” and as a result, it “abused its discretion in granting a preliminary injunction” to plaintiff West Virginia Rivers Coalition, the appeals court said.
