Chemours Says Broad Impact of PFAS Advisory Reviewable by Court

An EPA health advisory for two prominent “forever chemicals” is fit to be challenged in federal court after the agency said the advisory is immune to judicial review, Chemours argued in a legal brief.

Chemours Co. FC, LLC filed the brief Wednesday in Chemours v. EPA in the US Circuit Court of Appeals for the Third Circuit following the Environmental Protection Agency’s September motion to dismiss the case.

The company on Wednesday asked the court to deny EPA’s motion to dismiss.
