Chemours, DuPont Lose, for Now, Bid to Exit PFAS Damage Case

A federal district court says Chemours and DuPont must continue to defend themselves against claims that their PFAS releases in North Carolina damaged residents’ properties.

The US District Court for the Eastern District of North Carolina denied motions from the Chemours Co. FC LLC and E.I. du Pont de Nemours & Co. to decertify a court-approved class of residents and to dismiss their property damage claims.

But, the companies may be able to bring those motions again after the court has heard additional expert testimony, said Judge James C. Dever III’s order.
