Chemours Appears Likely to Win Appeal of Discharge Permit Order

The Chemours Co. appeared to convince a federal appeals court during oral arguments Thursday that an order requiring it to comply with its toxic discharge permit at its West Virginia Washington Works plant should be scrapped.

The panel of judges on the US Court of Appeals for the Fourth Circuit seemed to doubt a lower court’s ruling that the plant’s forever chemical discharges into the Ohio River caused irreparable harms to a member of the plaintiff group, West Virginia Rivers Coalition, because she stopped drinking tap water sourced from the waterway before the alleged permit violations began.
