Chemical Company No Longer Faces New York Odor Nuisance Claim

A nuisance case against a chemical company was dropped after a magistrate judge recommended ruling in favor of New York property owners.

South Buffalo Development LLC claimed that PVS Chemical Solutions Inc. interfered with the use of its properties in upstate New York through the “illegal movement and storage of rail cars.” The company also claimed in an amended complaint that PVS discharged sulfur dioxide, hydrogen sulfide, and noxious odors into the air from chemical manufacturing—counting as trespass and nuisance.
