California Restaurant Association Drops Natural Gas Ban Suit (1)

The California Restaurant Association on Monday moved to voluntarily dismiss its nearly five-year case against Berkeley, Calif.'s natural gas ban in new buildings, after the city agreed to repeal the restriction.

The parties “have resolved this case in its entirety,” the group told the US District Court for the Northern District of California.

  • Berkeley agreed in a settlement to repeal the challenged ordinance, which required appliances in newly constructed buildings to be electric in order to reduce emissions. The district court upheld the ordinance in July 2021, but the US Court of Appeals for the Ninth Circuit reversed that decision ...
