Alabama doesn’t meet the stringent criteria necessary to bring a petition against climate litigation efforts before the US Supreme Court, according to a brief filed by California.
Alabama Attorney General Steve Marshall (R) and 18 other Republican-led states urged justices in May to quash “unprecedented” litigation against energy companies brought by states across the US.
California, one of the states listed in the petition, submitted its arguments to justices on Wednesday, insisting that the claims brought by Alabama don’t meet the requirements needed to launch an original jurisdiction case before the Supreme Court.
