BP Found Liable for Indiana Oil Refinery Emissions Violations

BP Products North America Inc. can be held liable for exceeding its particulate matter emissions limits for boiler stacks at its Indiana oil refinery and for failing to retest those stacks, an Indiana federal court ruled Wednesday.

BP argued that the limit isn’t enforceable by itself and that the test required by the permit is unfair. However, those arguments are “designed to obscure the basic fact that BP repeatedly violated the emissions limit” established in the permit, according to the U.S. District Court for the Northern District of Indiana.
