The U.S. Supreme Court should affirm an appellate ruling that said the EPA can waive federal biofuels-blending requirements only in limited circumstances, the Biden administration and a coalition of biofuels advocates told the court in new filings.
Government lawyers laid out their arguments Wednesday, saying the U.S. Court of Appeals for the Tenth Circuit last year correctly determined that the Environmental Protection Agency overstepped when it let three small refineries off the hook for blending requirements under the federal Renewable Fuel Standard.
