Biden’s Power Plant Rules in Crosshairs of Skeptical DC Circuit

Members of a three-judge appellate panel scrutinized the EPA on Friday over contested rules that establish stringent emission limits for coal-fired power plants.

The Environmental Protection Agency and its challengers met at the US Court of Appeals for the District of Columbia Circuit for oral arguments in West Virginia v. EPA, the latest case to challenge rules that govern power plant carbon emissions that have yet to stick through changing administrations.

The regulations once again are facing an appellate panel that is wary of EPA assertions that their regulations land well above board of Clean Air Act requirements.
