Biden’s Monuments Decision Is Reviewable, Appeals Court Says (1)

Monuments created under the Antiquities Act are subject to judicial review, an appeals court ruled Tuesday, allowing Utah’s challenge to Bears Ears and Grand Staircase-Escalante national monuments to proceed.

The US Court of Appeals for the Tenth Circuit vacated a district court’s 2023 ruling that Antiquities Act cases aren’t subject to judicial review, and the panel remanded the merits of the challenge back to the district court.

The ruling will determine the route Utah and other western states may take in challenging large national monuments designated by presidents.
